M.A.S.C. The mexican experience
Synopsis
The Mexican legal system has been mutating from a traditional system of administration and prosecution of justice (inquisitorial system) to an adversarial justice system in which the parties, in the use of their most pristine rights, resolve their differences through dialogue. , on a level of equality and balance, in a self-composing manner, using the Alternative Dispute Resolution´s (A.D.R´s) by virtue of these being a legal tool that the judiciary itself has placed in the hands of individuals, through two changes very important for the operators of Mexican law, such as the constitutional reform of June 18, 2008, which requires a series of modifications from which orality in trials and the application of Alternative Dispute Resolution Mechanisms derives. in the criminal field, and 16 years later, an adjustment occurs to the Mexican legal sphere, for the application of this type of legal and social tool, regulating itself in civil and administrative matters, to be integrated in a complementary way on January 26, 2024, establishing a new paradigm of exercise of law, placing Mexico on an international level of legal and social vanguard.
